American singer and songwriter Miley Cyrus, who won her first Grammy Award for her song “Flowers” this year, has been sued in Los Angeles federal court for allegedly copying a portion of Bruno Mars’ 2013 hit “When I Was Your Man”. Miley, along with the co-writers of “Flowers”, Gregory Hein and Michael Pollack, has been named in the lawsuit.

Interestingly, Bruno Mars is not listed as a plaintiff in the case. Instead, the lawsuit has been filed by Tempo Music Investments, a company that purchased part of the rights to “When I Was Your Man” from one of its co-writers, Philip Lawrence. The lawsuit also targets Sony Music Publishing, Apple, Target, Walmart, and other companies for distributing “Flowers”.

According to a report by The Guardian, the lawsuit claims, “Any fan of Bruno Mars’ “When I Was Your Man” knows that Miley Cyrus’s “Flowers” did not achieve all of that success on its own. “Flowers” duplicates numerous melodic, harmonic, and lyrical elements of “When I Was Your Man”, including the melodic pitch design and sequence of the verse, the connecting bass line, certain bars of the chorus, certain theatrical music elements, lyric elements, and specific chord progressions.”

It continued, “It is undeniable based on the combination and number of similarities between the two recordings that “Flowers” would not exist without “When I Was Your Man”. With “Flowers”, Cyrus, Hein and Pollack have created a derivative work of “When I Was Your Man” without authorisation.”

Back in 2023, many fans were quick to notice similarities between the lyrics of the two songs, with some speculating that Miley’s “Flowers” was directed at her former long-time boyfriend and ex-husband, Liam Hemsworth. Rumours circulated that Miley had “flipped” Bruno Mars’ 2013 hit, which Liam had once dedicated to her during their relationship. It’s also worth noting that “Flowers” was released on Liam’s birthday. While Miley’s song focuses on self-reliance and self-love, Bruno’s song expresses a man’s regret for not treating his partner better and his fear of losing her.

Miley Cyrus first rose to fame as a child star on Disney Channel’s television series Hannah Montana (2006), in which she played a teenager living a double life as both a famous pop singer and an ordinary girl. In addition to starring in the series, she also provided vocals for its soundtrack, which were immensely successful on the Billboard charts. After Hannah Montana, Miley went on to establish a successful career as a singer and songwriter. However, despite her years in the industry, it wasn’t until 2024 that she won her first Grammy. “Flowers” won two Grammy Awards, including Record of the Year, while her album was nominated for Album of the Year.
